LEGAL NOTICE – TRADEMARKS, LOGOS, IMAGES AND CUSTOMER LIABILITY

1. Intellectual Property of Trademarks

All trademarks, logos, trade names, graphics, model names and any other distinctive signs displayed on this website or in images published by MOTOGPRICAMBI SRL are and remain the exclusive property of their respective owners.
They are protected by:

• Directive 2004/48/EC (enforcement of intellectual property rights),
• Italian Law No. 633 of April 22, 1941 (copyright law),
• Legislative Decree No. 30 of February 10, 2005 (Italian Industrial Property Code),
• Article 1-bis of Royal Decree No. 929 of June 21, 1942,
• and all other applicable national and international regulations.

The use of such trademarks by MOTOGPRICAMBI SRL does not imply any affiliation, sponsorship, or official approval by the trademark owners.

2. Descriptive Use and Compatibility

Any references to trademarks or motorcycle models serve exclusively a descriptive function for aftermarket parts and fairings compatible with specific motorcycles, in accordance with Article 21, paragraph 1, letter c) of Legislative Decree No. 30/2005.
All parts sold are non-original, unless explicitly stated otherwise.

3. Custom Work and Customer Responsibility

Graphics, stickers or decorations containing logos, emblems, wording or symbols related to registered trademarks are created exclusively upon request by the customer, who:

• voluntarily provides the files or images via email, digital tools or courier;
• declares, under their own responsibility, to hold the right to use such content or to have obtained it from copyright-free sources;
• authorizes MOTOGPRICAMBI SRL to use such elements solely for the specific requested work;
• accepts that such work is intended exclusively for personal, private, and decorative use.

The customer assumes full civil and criminal liability for any unauthorized, illegal, or improper use of the trademarks.

4. Release of Liability and Indemnification

By submitting an order and requesting custom work, the customer expressly declares and agrees to the following:

"I authorize MOTOGPRICAMBI SRL to reproduce the graphics and logos I have provided, declaring that I hold the necessary rights or authorizations. I release the company from any liability in case of claims by trademark owners or third parties, assuming full responsibility for any legal consequences."

This clause is contractually binding and constitutes a full and irrevocable indemnity.

5. Publication of Images and Graphics

Images published on the website or on MOTOGPRICAMBI SRL’s social media channels (Instagram, Facebook, etc.) depict actual work carried out upon customer request.
Such content is for illustrative, artistic, and demonstrative purposes only.

MOTOGPRICAMBI SRL:

• does not advertise any brand as its own;
• does not reproduce or sell logos owned by others on its own initiative;
• does not suggest any commercial affiliation with the manufacturers shown in the photos.

6. Limitations on Product Use

Customized products featuring graphics or logos of registered trademarks:

• may not be used for industrial, promotional, advertising, or competitive purposes;
• are intended solely for decorative and private use (e.g., amateur track days, personal use);
• may not be resold with the applied customization, nor publicly displayed in commercial contexts.

Any misuse or unauthorized use is strictly prohibited by law and shall be the full responsibility of the buyer.

7. Right of Refusal

MOTOGPRICAMBI SRL reserves the right to refuse any project involving the reproduction of copyrighted elements or registered trademarks if there is any doubt as to the customer’s legal ownership or authorization to use them.

8. Jurisdiction

For any legal disputes, the Court of Verona (Italy) shall have exclusive jurisdiction.
